CA Judge Overturns Assault Weapons law

Judge compares AR15 to a swiss army knife?  Are we headed back to the supreme court who has already stated the right to bear arms doesn't mean any weapon you want.  Whatever side you're on, it should be interesting to follow. A Swiss Army Knife?  : :) : :) : :) [/size]

It's true that he compares the AR-15 to a Swiss army knife, but you also have to consider the nature of the comparison.  He says:

""Like the Swiss Army knife, the popular AR-15 rifle is a perfect combination of home defense weapon and homeland defense equipment. Good for both home and battle," the judge said in his ruling's introduction."

So he's not comparing the knife and rifle based on lethality, but on the rifle's utility in different situations.  I think the reason for the comparison is to distinguish the AR-15 from automatic weapons which will fire rounds for as long as the trigger is held down.

I'll bet it doesn't even get past The Ca. state supreme court.

BTW: I'm hoping it will, nothing better I would like then to see this issue decided by The Supreme court once and for all when it comes to states rights and states deciding which weapons are legal and which weapons are not.[/size]

My knowledge of the Constitution (at this level), but I'd be interested if the U.S. Supreme Court agrees to hear this case.  On the one hand, if the government can ban booze at the federal level then it can ban guns.  On the other hand, our right to get snoggered is not constitutionally guaranteed.

Just shows how much you don't know Sidewinder. The Cali supreme court has nothing to do with this ruling !  It is in the Federal Court System, not you Communist Cali Courts.    And you claim state's rights LOL  The State of Cali does not supersede the Constitution of The United States of America.

You are right, It's a federal judge.  So I take it this will be heading to The Supreme court?  As I said, it should be interesting to follow.  This is CA but could affect 6 other states.

If it does work its way up to the Supreme Court it could be several years in the making as it still would have to go through the 9th circuit court first. Also, SCOTUS could just decline to consider it as they have on many other 2A cases in the past. However, they did recently accept a 2A case from the state of New York that likely will be decided next spring and the ruling will be significant in determining what limits of authority States have when it comes to gun permits.

IT should also be noted that the judge in question put 30 day stay on his own decision, given that he knows CA will be appealing the decision. So that means, sadly, no one is going to be going out to buy UN-neutered rifles just yet : :) .
