If it is how the law is now, then it's already overreaching.  Due process is being ignored and it sounds like no evidence is required.  So if someone tries to abuse the law (my example of taking my neighbor's guns to settle a grudge) they can do it.  I'm assuming the person isn't being violent because then (I think) they can be detained via a 911 call.

If you threaten suicide or to kill someone it's obvious but other than that it's not that easy. Law enforcement and judges are not trained physicians so how do they know? Also, the accuser presents their side and the accused has to wait for later in the process. Doesn't seem fair to be able to accuse someone and they have no defense.

But the fact is all of this takes time. If someone can legally purchase as weapon first, there is no way to enforce the red flag law in time to prevent them from using those weapons in a mass shooting.

We've known in at least 2 of these most recent shootings that the people have had mental health issues, and yet they were still able to go purchase weapons just prior to their mass killings.

The red flags law don't work, not because they are taking away weapons from the innocent, but the opposite, it still allows people with mental health issues to still buy weapons and perform this violent acts before any red flag can be enacted.

I read Rachel's article and the basic process is this:
Accuser files paperwork and petitions the judge to have guns removed from accused
Judge interviews accuser (Note:  Accuser can't be cross-examined by accused's counsel)
Judge interviews accused and the accused can have counsel (Note:  This is at a separate time from the accuser's interview)

You want less people being killed, and I do too.  So I think your intentions are good, and I'd like to hear what you would change in this process.  My primary objections are:
  • Lack of due process because the accuser can't be cross-examined
  • Abuse of the process.  The article quotes a red-flag advocate with

"It's not something that I think people enjoy doing." when I copy/pasted from the article.  It allowed it in my edit just now, but that's because I used the " from the keyboard and not the curved " from the article.  That's probably what caused the problem for other people.

The problem is the timing. The guns aren't removed nor is the accused's ability to acquire more weapons deterred until after the due process is complete. Meanwhile we have these people who are known to have a mental illness able to purchase weapons and commit these mass shootings.


I understand the fear of false accusations. But I believe we need to act on the side of public safety. And I'd take it over attempting to ban the weapons themselves.

Guys, you got it all wrong. Stop taking sides and thinking that liberal or conservative is best. This is not life and it is not reality. When you subscribe to these ridiculous notions of right and wrong you let them define you. Liberal are not communists and conservatives are not fascists. In fact, I doubt very few people could even define fascism. California is not all socialists and they don't all drive little cars. I know many Californians that are gun-toting big truck-driving people and many Texans that don't like guns and drive economy cars.


I know what Communism is and nothing here is even remotely close.


The problem here is the culture. It is narcissistic and self-righteous. Everyone knows what's best for everyone else. No one wants to talk about the real reason there is so much violence. The nonstop violence in media and video games. The romanticization of war. Billions are being made off of kids playing shooters for days on end. Billions made on endless streams of movies with gratuitous violence.


Don't tell me some study says it doesn't affect people because that is bs. Kids especially form their ideas and beliefs around what they see and what they see is violence nonstop.


You can NOT put the genie back in the bottle on guns. You cannot stop murder with laws when everyone is crazy. People aren't shooting up places because of guns, they are shooting up everything because that all they see. Violence. The spike is more likely from the pandemic. People are cooped up and over time their resentments fester and they spend days on end watching Netflix. It's depressing and causes people to lose it.


Ask yourself this. Is a person that shoots up a place and kills a bunch of people and then themselves in their right mind? They have cracked and lost it. Why is that? Why do they lose their mind and commit such murderous acts? Not because of guns. They have lost it because of society and all its hate and violence. Social Media allows mobthink to run unchecked and cause damage. So much hate and it just flows like a waterfall into people's psyche. I'm surprised it's not ten times worse by now.


Sure we could temper some of the more loose gun regulations but you aren't getting rid of what is already out there. Fix our society and then many things will get better.

The problem with that argument is that other countries have the same media. All of our entertainment is consumed worldwide. Yet they have no where near the gun violence that we do in the US. To say fix the media and violence ends just doesn't seem to apply.

OTOH, take a look at Australia since they went tough on guns. Mass shootings and gun violence way down. Same media.

It can be done, but we choose not to.

Fellers who constantly feel the need to shove their guns in other people's faces are the ones who make it bad for other gun owners.  A close friend of mine who I worked with and retired to Nevada has a concealed carry permit in Nevada.  You never know when he is carrying it or not as he doesn't feel the need to try and show it every chance he gets or strap it on his hip and walk down the street with it.  He also does not try and carry it in businesses that have a policy against weapons.
